Definition:

A non – solicitation agreement is when an employer agrees for an employee to solicit clients and customers of the organization, even after they leave; the employee will however not be able to do so for a specific period of time.

This type of agreement can be of a risk to the organisation because the ex – employee might end up becoming one of the main organization’s competitors; considering the fact that the employee might have been working for the organization for a number of years, it could possibly mean that holds some confidential information which could be used for their own gain in the future. Employers must therefore ensure that proper terms and conditions are discussed and signed in the agreement.
