Definition:

Sexual harassment refers to the continued and repeated unwelcome sexual advances or conduct of a sexual nature in the workplace.

The Sex Discrimination Act makes it unlawful to sexually harass another person in education, employment, or the provision of goods and services (meaning it extends to treatment of clients, not just other employees).

Steps to avoid sexual harassment within the workplace

Employers must take steps to try and avoid sexual harassment being practiced within the organization. As an employer, you should aim to have a culture of zero tolerance for sexual harassment. Below are some of the steps employers can take to avoid sexual harassment:

  • Train all employees on recognising sexual harassment and encourage them to report it 
  • Ensure that all policies are consistent, and in having zero tolerance of sexual discrimination
  • Ensure that you make it clear to your clients, suppliers and employees that sexual harassment is not tolerated
  • Offer support to any individual that is involved in a sexual harassment compliant
  • Reduce the risks of sexual harassment to make sure that the organization is a safe place to work in.
